Kingspan GmbH is responsible as content provider according to §5 Abs.1 Mediendienste-Staatsvertrag for the "own contents", which it provides for use, according to the general laws. A distinction must be made between this own content and cross-references ("links") to content provided by other providers. Kingspan GmbH is only responsible for this external content if it has positive knowledge of it (i.e. also of illegal or punishable content) and if it is technically possible and reasonable for it to prevent its use (§5 Para. 2 Mediendienste-Staatsvertrag). Kingspan GmbH has checked the external content at the time of the initial linking to determine whether it could give rise to any civil or criminal liability. However, the company is not obligated to constantly check the content to which it refers in its offer for changes that could give rise to a new responsibility.
